The dilemma of vacant beds: Did liberal CON policies toward hospitals make nursing homes ’sick’?

Hospital regulators use certificate-of-need (CON) licensing for multiple purposes and objectives. In an attempt to relieve financial distress of acute care hospitals in Florida, CON restrictions on skilled nursing home care were relaxed during much of the 1990s to allow hospitals to provide lucrative post-discharge care under Medicare. The consequences of this policy for freestanding skilled nursing facilities are examined in this paper. We find that the freestanding nursing home industry was deprived of Medicare revenue from post-discharge patients as a result of the growth in hospital based skilled nursing care. This policy, together with an unfavorable Medicaid reimbursement structure and life-time residency obligations, contributed to financial distress within the nursing home industry.
